This 20 acre community park is located on Bayou Texar in Pensacola.  There are eight tennis courts, an outside arena, picnic and children's play areas.

SMART HOME FINANCING RESOURCES - info by PENSACOLA REALTOR, JEANNETTE SPENCER

American Recovery and Reinvestment Act of 2009 includes several home-buying incentives. Here are three examples:

  • Homebuyer Tax Credit – The bill provides an $8,000 tax credit that is available to first-time homebuyers for the purchase of a principal residence from Jan. 1, 2009 through Nov. 30, 2009.  The credit does not require repayment.

How to get the $8,000 credit

  • FHA, Fannie Mae and Freddie Mac Loan Limits – The bill reinstates last year's 2008 loan limits for FHA, Freddie Mac and Fannie Mae loans.

Check out the loan limits in your county

  • Neighborhood Stabilization - The bill provides $2 billion in additional funding for the Neighborhood Stabilization Program (NSP).  The funds can be used to purchase, manage, repair and resell foreclosed and abandoned properties. In addition, the funds can also be used by states and localities to establish financing methods for the purchase and redevelopment of foreclosed properties.

    Learn more

Another home-buying incentive program is the Florida Housing’s First Time Homebuyer Program (FTHB). Qualified first-time buyers may receive a 30-year fixed interest rate mortgage loan through a network of participating lenders and lending institutions. Florida Housing also offers down-payment and closing-costs assistance to eligible borrowers, which can greatly reduce out-of-pocket expenses for the buyer. Even people who are not first-time buyers may be eligible for this program if they purchase a home in a specially designated target area. This program uses income and purchase price limits to determine eligibility.

More opportunities for first-time homebuyer grants

Local and regional incentive programs are available throughout the state. Some Florida counties and cities offer special financing assistance for low- or moderate-income buyers, especially those purchasing their first home. For information, talk with your local Board, a local lending specialist or go to your county government Web site.

Attractive mortgage rates

Attractive mortgage rates Mortgage interest rates in 2009 hover at historically low levels, providing a tremendous financial advantage for buyers with good credit. For example, the monthly principal and interest payment on a 30-year, fixed-rate mortgage of $100,000 at 5.5 percent would be about $570 – well below the cost of renting in most Florida markets.

“The Fed’s action to slash interest rates, coupled with the actions by the Federal Housing Finance Agency and the Department of the Treasury, has driven down interest rates to make the dream of homeownership once again attainable for thousands of Americans,” says Charles McMillan, president of the National Association of Realtors® (NAR).

In a boon for investors, Fannie Mae also changed its current limit of four financed properties per borrower to allow five to 10 financed properties per borrower, when eligibility requirements are met.

The Federal Housing Administration also has increased the maximum mortgage loan limit. As a result, FHA-backed loans are growing in popularity and now make up about 30 percent of new mortgage originations, according to NAR.

Other Financing Options

Florida buyers have other options for financing a home, depending on their individual situation. One effective approach is seller financing: asking the current owner to hold a first or second mortgage in order to complete the sale. That means the seller would receive a steady stream of income (the mortgage payment plus interest) over the years, rather than an immediate lump-sum payment.

Some Florida employers offer housing assistance programs for relocating employees. This may be an option to explore in cases where the buyer is taking a new job with a large company, hospital or other organization.

A third approach is to see if the buyer has other assets, such as an income-producing property, a business, boat or recreational vehicle (RV) that could be used as security for a mortgage loan.

Florida’s existing home, condo sales up in September 2009 - Pensacola Condos
November 12th, 2009 7:41 PM
Florida’s existing home, condo sales up in September 2009

National Association of Realtors article provided by Jeannette Spencer, Pensacola Realtor http://www.the-best-of-florida.com    877-461-9907 toll free

Big rebound in existing-home sales shows first-time buyer momentum.

ORLANDO, Fla. – Oct. 23, 2009 – Florida’s existing home sales rose in September, which marks more than a year (13 months) that sales activity has increased in the year-to-year comparison, according to the latest housing data released by Florida Realtors®. September’s statewide sales also increased over sales activity in August in both the existing home and existing condominium markets.

Existing home sales rose 34 percent last month with a total of 14,419 homes sold statewide compared to 10,778 homes sold in September 2008, according to Florida Realtors. Statewide existing home sales last month increased 4.1 percent over statewide sales activity in August.

Florida Realtors also reported a 77 percent increase in statewide sales of existing condos in September compared to the previous year’s sales figure; statewide existing condo sales last month rose 8.9 percent over the total units sold in August.

All of Florida’s metropolitan statistical areas (MSAs) reported increased existing home sales in September; all but one MSA also showed a gain in condo sales. A majority of the state’s MSAs have reported increased sales for 15 consecutive months.

Florida’s median sales price for existing homes last month was $142,000; a year ago, it was $174,900 for a 19 percent decrease. Housing industry analysts with the National Association of Realtors® (NAR) note that sales of foreclosures and other distressed properties continue to downwardly distort the median price because they generally sell at a discount relative to traditional homes. The median is the midpoint; half the homes sold for more, half for less.

The national median sales price for existing single-family homes in August 2009 was $177,500, down 12.1 percent from a year earlier, according to NAR. In Massachusetts, the statewide median resales price was $315,000 in August; in California, it was $292,960; in Maryland, it was $265,862; and in New York, it was $205,000.

NAR’s latest industry outlook notes positive signs in the housing sector, but adds that extension of the federal first-time homebuyer tax credit would help sustain a fragile recovery. “Now that the market is showing some momentum, we have an opportunity to achieve a more rapid and broader stabilization in home prices,” said NAR Chief Economist Lawrence Yun. The outlook for home sales and prices depends on whether the tax credit is extended, he said, describing it as “the best tool in our arsenal to encourage financially qualified buyers to stimulate the economy and help reduce the budget deficit.”

In Florida’s year-to-year comparison for condos, 5,088 units sold statewide last month compared to 2,870 units in September 2008 for a 77 percent increase. The statewide existing condo median sales price last month was $102,500; in September 2008 it was $153,500 for a 33 percent decrease. The national median existing condo price was $179,300 in August 2009, according to NAR.

Interest rates for a 30-year fixed-rate mortgage averaged 5.06 percent last month, a significant drop from the average rate of 6.04 percent in September 2008, according to Freddie Mac. FAR’s sales figures reflect closings, which typically occur 30 to 90 days after sales contracts are written.

Among the state’s smaller markets, the Pensacola MSA reported a total of 275 homes sold in September compared to 267 homes a year earlier for a 3 percent increase. The market’s existing home median sales price last month was $135,000; a year ago it was $146,900 for an 8 percent decrease. A total of 48 condos sold in the MSA in September, up 41 percent over the 34 units sold in September 2008. The existing condo median price last month was $190,000; a year earlier, it was $180,000 for a 6 percent gain.

FHA 203(k) loans on the rise by JEANNETTE SPENCER, PENSACOLA REALTOR with CONNELL & MANZIEK
November 12th, 2009 7:37 PM
FHA 203(k) loans on the rise

A Streamlined 203(k) provides extra money on top of the mortgage to pay for improvements such as a new roof, appliances, furnace, energy-efficient windows and cosmetic improvements like carpet, paint, and remodeled kitchens and baths.

The maximum rehab loan is $35,000, but the Streamlined 203(k) allows the money to be rolled into the entire mortgage, so the repairs can be paid off over time along with the house.

Under the program, a seller is paid at closing, and the remaining money from the Streamlined 203(k) goes into an escrow account. As repairs are completed, money is removed from the 203(k) escrow account to pay for them.

There are other rules. A licensed contractor, for example, must complete the work within six months, though some lenders allow the borrower to do minor cosmetic work, such as painting.

For more info on the Streamlined 203(k) program visit the Department of Housing and Urban Development website at: http://www.hud.gov/offices/hsg/sfh/203k/203kslrp.cfm

The present, higher loan limits expire at the end of 2009 and revert to previous lower limits. The move still needs to be signed by President Obama, which is expected shortly.

The National Association of Realtors® (NAR) thanked Congress for speedy action.

“NAR commends both houses of Congress for their quick action in continuing these higher limits during a time for recovery in the housing market and national economy,” says NAR President Charles McMillan. “The higher limits, along with the homebuyer tax credit extension, are necessary to keep the markets moving at this critical time.

“Home sales have shown significant movement upwards in the past six months, and reduced inventory in some segments of the housing market, but not in all. Home purchases in the middle-income and higher brackets have not moved much, and those markets must improve before we can experience a fully sustained housing recovery. These higher loan limits will help motivate qualified homebuyers to purchase in those markets,” McMillan said.

The resolution would extend the present loan limits for FHA, Fannie and Freddie through the 2010 calendar year at 125 percent of local median home sales prices, up to a maximum of $729,750 in high-cost areas. The floor for FHA is $271,050; the floor for Fannie Mae and Freddie Mac conforming loan limits is $417,000.

Obama signs bill: Homebuyer tax credit extended by Jeannette Spencer

Obama signs bill: Homebuyer tax credit extended - TO BUY A HOME CALL JEANNETTE SPENCER 877-461-9907 for PENSACOLA REAL ESTATE or PENSACOLA HOMES!

Homebuyer tax credit program extended

Cynthia Shelton, 2009 Florida Realtors® president, shares the great news about the newly extended and expanded homebuyers tax-credit program.

WASHINGTON – Nov. 6, 2009 – President Obama signed H.R. 3548 this morning, enacting into law an extension, and adjustment, of the $8,000 tax credit for first-time buyers. Among other things, the extension adds money for certain move-up buyers; creates one deadline for signing a contract and a later deadline for closing; changes income requirements; and limits a purchased home’s cost to $800,000.

“Extending the homebuyer tax credit and expanding it to reach more homebuyers is the right thing to do,” says 2009 Florida Realtors® President Cynthia Shelton. “It is critical to maintaining the positive momentum we’ve been experiencing in the housing market and in the overall economy. Florida Realtors applaud congressional leaders for taking action to extend the homebuyer tax credit into 2010, which will help Florida families realize their dream of homeownership, improve our communities and strengthen our economy.”

Adds John Sebree, Florida Realtors vice president of public policy, “Florida residents enjoy two additional advantages. The Florida Homebuyer Opportunity Program (FHOP), created by the Florida Legislature earlier this year, still has approximately $28 million that first-time homebuyers can access and use toward their downpayment. And move-up buyers now have the ability to ‘port’ their current property tax savings to a new home.”

First-time homebuyers

Most details for first-time homebuyers mirror the rules currently in existence. The maximum tax credit remains $8,000 ($4,000 for married individuals filing separately), and anyone who has not owned a home within three years is considered a “first-time buyer.”

• A purchase must be under contract by April 30, 2010.

• A purchase under contract by April 30 must close no later than June 30, 2010.

• After Dec. 1, 2009, income limits rise to $125,000 for singles and $225,000 for married couples; up from limits effective through Nov. 30 of $75,000 for singles and $150,000 for married couples. The tax credit phases out incrementally at each $20,000 increase in income.

• Effective immediately: The maximum home value purchased cannot exceed $800,000. Prior to the law being signed, first-time homebuyers had no limitation on a home’s cost.

Current homeowner tax credit

An existing homeowner who purchases a home may now claim a tax credit of up to $6,500. To qualify, that owner must have owned and used the same residence as a principal residence for any consecutive five-year period in the previous eight years.

• This new tax credit is effective immediately. Eligible homebuyers do not have to wait until Dec. 1 to close in order to qualify.

• Personal income limits, maximum home value, and contract/closing deadlines are the same as those for first-time homebuyers.

Long-time Florida homeowners who enjoy discounted property taxes resulting from the state’s Save Our Homes amendment qualify for property tax portability, notes Sebree. For more information or to calculate how much tax savings can be transferred to a new home, visit floridarealtors.org at: http://www.floridarealtors.org/LegislativeCenter/TopInitiatives/index.cfm

Florida Homebuyer Opportunity Program

Under FHOP, first-time Florida homebuyers can obtain interest-free bridge loans to access their federal tax credit before they complete a home purchase, enabling them to use that money upfront for downpayment and closing costs. Once buyers submit their returns to the IRS and receive their tax credit money, they repay their loans to the state.

The Florida Realtors-backed program came out of the 2009 session of the Florida Legislature. However, as part of the 2009-2010 budget year, did not become effective immediately. They tax credit extension will allow many first-time buyers to tap into the approximately $28 million in the program's remaining funds.

While funded by the state, the money is distributed through the city and county housing offices that operate the State Housing Initiatives Partnership (SHIP) program. There is no standardized program, and each local agency may operate under different rules for distribution. For more information, buyers should contact their local SHIP office.

To find a local SHIP office, go to: http://apps.floridahousing.org/StandAlone/FHFC_ECM/AppPage_SHIPLGContacts.aspx.

Additional changes

The tax credit extension includes other new rules, such as:

• The new law also impacts dependent purchases of homes, which weren’t addressed under the old rules.

• The new law requires a buyer to attach documentation about the home purchase to his or her income tax return. An audit found that some buyers are claiming the tax credit when they don’t deserve it, and investigators continue to seek out fraud. To minimize tax abuse going forward, buyers won’t receive the credit without submitting proof to the Internal Revenue Service (IRS).

The homebuyer tax credit is collected as part of the normal income tax process. As a credit, it’s calculated separately from an individual’s income tax, and paid regardless of taxes owed or withheld from income. As always, however, only a tax planner can render specific advice to anyone seeking the credit. For more information on the credit, contact a tax planner or visit the IRS website at: http://www.irs.gov.

What is a LETTER OF INTENT?
November 12th, 2009 4:48 PM

A letter of intent or LOI is a document outlining an agreement between two or more parties before the agreement is finalized. The concept is similar to the so-called heads of agreement. Such agreements may be Asset Purchase Agreements, Share Purchase Agreements, Joint-Venture Agreements and overall all Agreements which aim at closing a financially large deal.

LOIs resemble written contracts, but are usually not binding on the parties in their entirety. Many LOIs, however, contain provisions that are binding, such as non-disclosure agreements, a covenant to negotiate in good faith, or a "stand-still" or "no-shop" provision promising exclusive rights to negotiate. A LOI may also be interpreted as binding the parties if it too closely resembles a formal contract.

The purposes of an LOI may be:

  • to clarify the key points of a complex transaction for the convenience of the parties
  • to declare officially that the parties are currently negotiating, as in a merger or joint venture proposal
  • to provide safeguards in case a deal collapses during negotiation

A LOI may also be referred to as a memorandum of understanding (MOU), term sheet or discussion sheet. The different terms reflect different styles, but do not indicate any difference under law. A contract, in contrast, is a legal document governed by contract law.

There is however a specific difference between an LOI and MOU, whereby an LOI is the intent from one party to another and does not in this case have to be signed by both parties, whereas an MOU is an agreement between two or more parties, which should be signed by all parties to be valid.

This started as a way to help our daughter in graduate school since I either make or import pearls direct from the pearl farmers.  As I looked at the retail prices, I thought it would be a way to offer discounted jewelry to others so they can enjoy the wonderful pricing.

North Hill Pensacola
November 4th, 2009 7:02 PM

Click on picture above to link to all available NORTH HILL HOMES in Pensacola, Florida.  Note: pictures courtesy of Denise Daughtery.  TO VIEW THE FEATURED NORTH HILL HOME, be sure to scroll to the bottom of the page.  Although it is not my personal listing, I have always admired this house and it is located across the street from Alabama Square.

North Hill is an older neighborhood in Pensacola, Florida with unique architecture. North Hill is one of the largest residential historic districts in the State of Florida and is listed on the National Register of Historic Places.  It contains more than 400 historic homes built between 1870 and the 1930’s.  A stroll through our tree lined streets reveals a literal outdoor museum of architectural treasures from Queen Anne, Neoclassical, Tudor Revival, Craftsman Bungalow, and Mediterranean Revival to Art Moderne.  It is protected by zoning regulations and governed by the City of Pensacola Architectural Review Board to ensure the preservation of its distinctive architectural character and compatibility of future development.

The North Hill District enjoys a strong sense of community pride, not only in preserving our historic homes, but in preserving a quality of life enjoyed for well over 130 years. North Hill is a place where families of all types are made welcome and where neighbors get to know their neighbors

North Hill sits on a "Hill" NORTH of downtown Pensacola.  The homes are located on a ridge of high land overlooking historic downtown Pensacola. Its history is rich, from battlefield to preservation district, and all points in between.

North Hill Pensacola homes are unique. Pensacola's historic North Hill is located near downtown and East Hill.  Historic North Hill Pensacola, has many diverse architectural styles.

At the start of the 20th century, another group of Chicago architects was at the forefront in the devlopment of a distinctive midwestern residential mode know as the Prairie Style. The acknowledged leader and spokesman of the movement and the architect who produced the most noteworthy examples was Frank Lloyd Wright. The architect of the style consciously rejected currently popular academic revival styles and sought to create buildings that reflect the rolling midwestern prairie terrain on which they were to be built. As a restult, the Prairie house had a horizontal appearnace with a broad hipped or gabled roof and widely overhanging eaves. Often the roof was penetrated by a large, plain rectanglular chimney. Windows were usually casements arranged in horizontal ribbons. One story porches or porte cocheres, wall and terrances often extended from the main structure of the house and further emphasized its horizontal appearance. Achitects working in this style represent a major achievement, one of international importance, in American architectural development (Source: National Trust For Historic Preservation. "What Style is it? - A Guide to American Architecture." ISBN 0-471-14434-7).

The Greek Revival home is located in the North Hill Preservation District. The district is made up of 55 blocks of magnificent old family homes which were built "on the hill" to take advantage of the elevation and the cooling summer breezes from the Bay. Many of the homes were built during the booming lumber days of Pensacola when the influential citizens of the day wanted to be isolated from the noisy downtown area often plagued by drunken sailors and roudy lumbermen. (Source: Pensacola News Journal . "North Hill: Visions of Yesterday". Sept. 5, 1980.)

The Queen Anne style home were usually built in late 1800s. The style described buildings that were inspired by transitional architecture of the pre-Georgian period when classical ornament was grafted onto buildings of basically medieval form. As in the home at 620 North Barcelona, huge medieval-type chimneys were common. The roof is gabled with second -story projections borrowed from French chateaux. The gable ends are ornamented with stylized relief decoration. The porches opens the house to the outdoors. The picturesque effects of the Queen Anne style were employed to the best advantage in substantial, free-standing residences. The North Hill Preservation District has many excellent examples of this style. (Source: National Trust For Historic Preservation. "What Style is it? - A Guide to American Architecture." ISBN 0-471-14434-7).

Alabama Square on DeSoto and Reus Street was part of Andrew Jackson's original layout of the city. The city was designed so that a park would be no more than six blocks from any residence. The park was restored and refurbished recently by the North Hill Preservaton Association. (Source: Pensacola News Journal. "Facelift-City Refurbishes Alabama Square". Nov. 10, 1975.) The square is the central park for the North Hill Preservation District.  The park benches are popular spots in the park. There is a  childrens area.

The Turner shop is located at 815 North Baylen Street. It was built in 1896 by Charlie Hill Turner as a residence for his sister and brother-in-law as a mirror image of his house which is next door. His grandson, Bill Turner, turned the house into an antique shop and lives in the original house. Over the years, the original house has had parts added on, so the two houses don't look exactly alike anymore, but the resemblance is still there. (Source: Pensacola News Journal. ?Turner house remains in family.? March 28, 1992.)

The Turner Shop is located on Baylen Street in the North Hill Preservation District, adjacent to downtown Pensacola. The shop is located on the west side of Baylen Street. The Victorian home dates from the 1870's and is a significant contributing structure with lavish detailing. The lots in North Hill are large compared to those in the Seville Historic District.
