Question:
My Seller wants me to leave my listing 'Active' once I have a contingent contract.Is it okay to do this?
The MLS Department receives variations of this question frequently. MLS Rules and Regulations require the Contingent status be reflected on the listing in "Status" and not within property description or agent notes. As long as the seller has agreed to have the listing uploaded to the Service (MLS), then it (the listing) has to comply with the rules that govern the Service (MLS). We can require that a 'Contingent' status be reflected on a listing and also require a contingency reason be disclosed (right of first refusal is a contingency reason, folks!). We have checked this at both the state and national association policy level. So, the short answer is...No; a listing cannot stay within an 'Active' status with a contingent contract.
It is important to remember that Contingent listings continue to be sent to PensacolaMLS.com, REALTOR.com, Pensacola News Journal Homefinder website, and to Florida Living Network. Listings are only removed from public marketing sites once the status is PENDING
